What Are Sexual Offenses?

Sexual offenses are crimes that typically involve illegal or coerced sexual conduct against another person. Individuals convicted of sex crimes are considered sex offenders and have their names added to state and federal sex offender registries.

Types of Sexual Offenses

Sexual offenses for which individuals may be charged in Georgia include:

  • Indecent exposure: Exposing one’s genitals in public
  • Prostitution: Offering or engaging in sexual acts for payment
  • Solicitation: Enticing someone else to commit a crime, such as prostitution
  • Sexual assault: Unwanted sexual touching
  • Rape: Forcible penetration of a victim against his or her will
  • Statutory rape: Sexual intercourse by a person over the age of 17 with a minor under the age of 16
  • Child pornography: Any visual depiction of sexually explicit conduct involving a minor
  • Child molestation: Indecent acts in the presence of a child with the intent to satisfy sexual desires of the child or perpetrator; or physical injury to a child and some act of sodomy (aggravated child molestation)
  • Internet sex crimes: Illegal sexual activities involving the internet

What Are the Penalties for Sexual Offenses?

Although they vary depending on the specific offense, penalties for sexual offenses can be severe in Georgia. For example, statutory rape is punished by a prison sentence of 1 to 20 years, unless the victim is 14 or 15 and the defendant is no more than three years older, in which case the crime is treated as a misdemeanor. Prostitution and first-offense indecent exposure are also punished as misdemeanors. However, a person convicted of aggravated child molestation faces imprisonment for 10 to 30 years.

Preparing a Defense against Sexual Offense Charges

Effective defense strategies against sexual offenses do exist. It is critical to conduct a comprehensive investigation and thoroughly examine all accuser and witness statements. It is also important to examine the accuser’s personal and professional history and to conduct a detailed study of medical records, forensic evidence, and text messages, emails, and electronic data.
